Hi Brian,
I hope all is well.
I spoke to a few arborists when getting estimates to remove the trees listed on our proposal and was informed
that 3 of the trees are Water Oaks, not Sand Live Oaks, and are not on the mitigation / protected list.
I unfortunately do not have a copy of the original permit that I submitted to the township, but they are the 3
trees on the North East end of our property.
Would this change anything regarding our mitigation plan / payments.

Yes, you can pay instead. Once we receive the payment, the permit can be approved.
You can pay via check at city hall or by Visa or Mastercard over the phone at 904-247-5837 and referencing your tree
permit # TREE20-0038.

Rather than planting 5.37" of live oak trees as the mitigation plan - can we instead pay the township the
mitigation fee of 5.37 x $148 = $794.76?

It impacts which trees receive preservation credit. If you are doing $10k worth of construction within the next two
years, you will not receive preservation credit for any trees. Currently you are receiving preservation credit for a few
trees.

Thanks for the info. We have nothing officially planned yet, however we were looking into the logistics of
putting in a pool and renovating our existing patio. The combined cost would realistically exceed $10k and
could take place in the next two years, but is dependent on a number of unknown variables.

Our intention to remove the trees however, is not for construction purposes as the trees are well out of the
way of the area we wish to improve, but more for safety purposes as the trees over hang our roof and
branches have fallen and caused damage to our patio in the past.
Regardless of whether or not we are able to or want to proceed with these property improvements, we
would still want to explore the possibility of removing the trees due to the safety issues mentioned above.
What impact would this have on the mitigation plan?

Attached are your updated mitigation calculations showing that 5.375 inches of mitigation is required for
the proposed tree removal. I realized after we spoke that since you are not doing any construction you
received preservation credit for a few of the trees in your front yard. The reason you owe 5.375 inches is
Section 23-33 of the code states “When a legacy tree is removed, at least twenty-five (25) percent of
mitigation shall be provided on site in the form of replacement”. So 25% of 21.5 inches comes out to
5.375.

The next step is to send me a mitigation plan showing the location of the tree(s) you will plant for
mitigation credit. This plan can be hand drawn. Note that the species must be either sand live oaks or live
oaks and the minimum planting size is 4 inch caliper. As such, you either have to plant one 5.375 inch
tree or two 4 inch caliper trees.
I know that was a lot of information so let me know if you have any questions.
