THIS CAUSE came for public hearing before the Code Enforcement Special Magistrate on July 8,
2021, and the Special Magistrate having heard testimony under oath, received evidence, and heard
arguments respective to all appropriate matters, issues findings of fact, conclusions of law, and orders
as follows:
FINDINGS OF FACT
1. Respondent owns the property located at 945 Plaza, Atlantic Beach, Florida.
2. A hearing was held before the Code Enforcement Board on March 13, 2012. The
Respondent was given notice, but did not appear at that hearing. The Respondent was
ordered to correct the violations of Chapter 24-173(b) 1 & 5 and International Property
Maintenance Code, Chapter 3, Section 302.8 Motor Vehicles by cleaning up the
remaining items on the property and properly licensing his Jeep.
3. The Respondent was also assessed a $100.00 per day fine for failure to comply
commencing on April 13, 2012. The amount owed to date is $623,500.16.
4. The Property is being sold and the closing agent requested the issue of cleaning up the
Property and reducing the lien be placed on the July 8, 2021 hearing agenda.
5. The City of Atlantic Beach recommended a $10,000.00 lien be imposed and the new
buyer submit plans and permits to come into compliance before releasing the lien.
CONCLUSIONS OF LAW
6. A Judgment Lien was previously entered in this cause finding the Respondent in
violations of the "nuisance" codes and assessed a daily fine of$100.00 per day until in
compliance. The amount of the lien to date is $623,500.16. The agents for the closing of
the Property have requested a reduction in the lien and agreed to bring the Property into
compliance. The City of Atlantic Beach is in agreement.
ORDER
Based upon the foregoing Findings of Fact and Conclusions of Law and pursuant to the authority
granted in Chapter 162, Florida Statutes, and the Code of Ordinances of the City of Atlantic Beach,
Florida it is Ordered:
THAT the lien be reduced to $10,000.00 and that upon compliance of all violations and submission
of plans and permits be provided to the City of Atlantic Beach before releasing the lien.
DONE AND ORDERED THIS DAY OF 21ST JULY, 2021.
