Dear City of Atlantic Beach Commission Members;
We respectfully request a waiver of City Ordinance 19-7 (Construction of driveways in rights-of-way),
paragraph: f, in regards to a proposed construction of a driveway that would extend from our property
line at 239 Seminole Road onto the City Right of Way exiting onto Seminole Road. Our lot size is 75' X
100' and construction of a circular driveway on a lot less than 100' is not allowed.
We have currently lived at 239 Seminole Road since 1997 and take great pride in our home and the city.
We have worked hard in making our residence an attractive part of Atlantic Beach and welcome each of
you to stop by if there is any doubt. We believe that by granting us this waiver would not only allow us a
safer access to Seminole Road but also it would benefit the city due to the aesthetical pleasing appeal of
our residence.

Sec. 19-7. Construction of driveways in rights-of-way.
The construction of a new driveway in the city's right-of-way, or the modification of an existing
driveway in a right-of-way, shall require a construction permit within city rights-of-way and
easements. Said permit shall be issued subject to the following requirements:
(a) The proposed driveway shall not create more than fifty(50)percent impervious area within
the right-of-way.
(b) Any permit issued shall be a revocable encroachment permit if any nonstandard driveway
materials (i.e., pavers) are installed in the right-of-way. If the city is required to do any utility or
other work or repairs in a right-of-way which damages such nonstandard materials,the
homeowner shall be responsible for repairs necessary to the materials.
(c) Any construction within the city's rights-of-way shall not adversely affect or restrict public
parking in the rights-of-way.
(d) No parking aprons shall be allowed in the city's rights-of-way along arterial (through)
streets listed in city Code subsection 21-17(h).
(e) Any improvements in the city's rights-of-way that are not part of a driveway or sidewalk
shall be constructed of turf block or other pervious material.
(f) Maximum driveway width at the property line and through the right-of-way shall be twenty
(20)feet. Maximum driveway width for circular drives shall be twelve (12) feet, and circular
drives shall only be permitted on lots having at least one hundred-foot frontage.
(g) Maximum driveway width at the property line and through the right-of-way for duplexes on
a fifty-foot lot shall be a combined width for both driveways of twenty-four(24) feet.
(h) Driveways that cross sidewalks. City sidewalks may not be replaced with other materials,
but must be replaced with smooth concrete left natural in color so that it matches the existing and
adjoining sidewalks.

Allow a Circular Driveway on a Lot with Less Than 100 Foot Frontage.

BACKGROUND: Applicant proposes to add on to his existing driveway at 239
Seminole Road to create circular driveway with a second connection to Seminole Road.
City Code Section 19-7 contains the following requirements for circular driveways
(emphasis added):
(f) Maximum driveway width at the property line and through the right-of-way shall be
20 feet. Maximum driveway width for circular drives shall be 12 feet, and circular drives shall only
be permitted on lots having at least 100 foot frontage.
The applicant proposes to add an extension to his existing driveway to make a circular
drive (see Attachment 2). As discussed during Strategic Planning and various Commission
meetings,parking in the right of way on Seminole Road has been a concern both from the
right of way maintenance/appearance aspect as well as traffic safety. The proposed
driveway addition will provide some relief for this specific location. Estimated impervious
surface coverage of the right of way with the new driveway, including the City sidewalk, is
43%. Limit per City Code Section 19-7 is 50%.
BUDGET: No budget issues.
RECOMMENDATION: Consider approval of requested waiver to the City Code Section 19-7
requirements.
