1675 Beach Avenue VAR Order 07.19.1994 ACTION OF THE COMMUNITY DEVELOPMENT BOARD
OF THE CITY OF ATLANTIC BEACH
REQUEST FOR VARIANCE TO PROVISIONS OF CHAPTER 24 OF
THE CODE OF ORDINANCES OF THE CITY OF ATLANTIC BEACH
REQUESTED: Addition to the north side of the existing
nonconforming secondary dwelling at 1675 Beach Avenue which
has a south side yard setback of 2 . 5 feet where five feet is
required.
WHEREAS , Gilchrist B. Stockton, Jr. , owner of above described
property, has applied to the Community Development Board for a
Variance to the zoning regulations to allow an addition to his
existing nonconforming secondary dwelling , and
WHEREAS , the Community Development Board has considered the
application and rendered a decision, and
WHEREAS, It is the finding of the Community Development Board
that the granting of such Variance will not be ccntrary to the
public interest and owing to special conditions not resulting
from the actions of the applicant, a literal enforcement of the
provisions of the zoning code will result in unnecessary and
undue hardship, will not grant any special privilege and is the
minimum needed,
NOW THEREFORE, BE IT ORDAINED BY THE COMMUNITY DEVELOPMENT
BOARD OF THE CITY OF ATLANTIC BEACH THAT:
1 . The requested Variance is granted subject to provisions and
conditions described below.
2 . The owner of the real property described below is hereby
granted a zoning Variance from the provisions of Chapter 24 ,
Section 24-85( a) ( 1 ) of the Code of Ordinances of the City of
Atlantic Beach, specifically to allow the addition to the north
side of the secondary dwelling which will not increase the
nonconformance of the existing building . This Variance shall
run with the title of the real property described below.
3 . Owner and property description. The owner of the property
to which this Variance is granted is Gilchrist B. Stockton,
Jr. The property to which this Variance is granted is
described as :
Lots 16 , North Atlantic Beach Unit 1
Also known as 1675 Beach Avenue
4 . Effective Date. This order shall become effective upon
execution.
