77 Sherry Drive VAR Order 07.19.1994 ACTION OF THE COMMUNITY DEVELOPMENT BOARD OF THE CITY OF ATLANTIC BEACH REQUEST FOR VARIANCE TO PROVISIONS OF CHAPTER 24 OF THE CODE OF ORDINANCES OF THE CITY OF ATLANTIC BEACH REQUESTED: Addition to existing nonconforming residential. building to add a ground floor addition to the dwelling at 77 Sherry Drive which has a rear yard setback of 8 . 9 feet where twenty feet is required. - WHEREAS , Amanda Miller, owner of above described property, has applied to the Community Development Board for a Variance to the zoning regulations to allow an addition to her existing nonconforming residence , and WHEREAS, the Community Development Board has considered the application and rendered a decision, and WHEREAS, It is the finding of the Community Development Board that the granting of such Variance will not be contrary to the public interest and owing to special conditions not resulting from the actions of the applicant, a literal enforcement of the provisions of the zoning code will result in unnecessary and undue hardship, will not grant any special privilege and is the minimum needed, NOW THEREFORE, BE IT ORDAINED BY THE COMMUNITY DEVELOPMENT BOARD OF THE CITY OF ATLANTIC BEACH THAT: 1 . The requested Variance is granted subject to provisions and conditions described below. 2 . The owner of the real property described below is hereby granted a zoning Variance from the provisions of Chapter 24 , Section 24-85( a) ( 1 ) of the Code of Ordinances of the City of Atlantic Beach, specifically to allow the addition of a ground floor addition which will not increase the nonconformance of the existing building . This Variance shall run with the title of the real property described below. This Variance shall lapse if it has not been implemented or is not in progress six months from the date of this approval . Any extention to this time period must be specifically authorized by the Community Development Board. 3 . Owner and property description. The owner of the property to which this Variance is granted is Amanda Miller. The property to which this Variance is granted is described as: A tract of land in the unplatted west end of Block 2 , Atlantic Beach Subdivision "A" as recorded in Plat Book 5 , Page 69. Also known as 77 Sherry Drive 4 . Effective Date. This order shall become effective upon execution.
