137 10th Street VARIANCE 10.11.1990 (Cipollina) BEFORE THE COMMUNITY DEVELOPMENT BOARD
OF THE CITY OF ATLANTIC BEACH
VARIANCE PURSUANT TO CHAPTER 24-105(E) CODE OF
ORDINANCE OF THE CITY OF ATLANTIC BEACH
FOR: Encroachment of two feet into rear yard setback to
extend structure to add a bedroom and additional living
space on property located at 137 10th Street, also known
as LOT 7 and the east 16.7 feet of LOT 1, BLOCK 40, and
WHEREAS, ANTHONY CIPOLLINA and THERESA CIPOLLINA, owners
of the real property described in this order have applied
to the Community Development Board for a zoning variance
to encroach 2 feet into the rear yard setback, and
WHEREAS, the Community Development Board has considered
the application and rendered an opinion; and
WHEREAS, taking into consideration the above opinion,
the Community Development Board finds that the granting
of such variance will not be contrary to the public
interest and owing to special conditions a literal
enforcement of the provisions of the Zoning Code will
result in unnecessary and undue hardship; now THEREFORE,
BE IT ORDAINED BY THE COMMUNITY DEVELOPMENT BOARD THAT:
1 . Variance granted. The owner of the real property
described herein is hereby granted a zoning variance
from the requirement of Chapter 24-105e of the Ordinance
Code of the City of Atlantic Beach. Owner is hereby
granted a variance to extend the structure 2 feet in the
rear yard setback, and said variance shall be trans-
ferable and shall run with the title of the above-
described property.
2. Owner and Description. The owners of the property
to which this variance is granted by this order ANTHONY
CIPOLLINA and THERESA CIPOLLINA.
The property is described as:
Lot 7 and the east 16.7 feet of Lot 1
Block 40
3. Effective Date. This order shall become effective
upon execution.
