AN ORDINANCE REGULATING HOURS FOR THE
SALE OF ALCOHOLIC AND INTOXICATING BEV-
ERAGES IN THE CITY OF ATLANTIC BEACH,
FLORIDAp RESTRICTING THE LOCATION WHEREIN
A VENDOR OF ALCOHOLIC BEVERAGES SHALL BE
PERMITTED TO CONDUCT HIS PLACE OF BUSINESSp
FIXING THE MINIMUM VOLUME OF LIGHT TO $E
MAINTAINED AND REQUIRING THE SAME TO BE
MAINTAINED UPON THE PREMISES OF EACH VENDOR
LICENSED TO SELL ALCOHOLIC BEVERAGESp PRO-
HIBITING UNNECESSARY AND UNUSUAL NOISES AND
REGULATING THE USE OF PUBLIC ADDRESS AND
LOUD SPEAKER EQUIPMENT; AND REPEALING OR-
DINANCE NUMBERS 10-59-6, 10-
59-7, AND 177.BE IT ENACTED BY THE PEOPLE OF
THE CITY
OF ATLANTIC BEACH, FLORIDAs Section 1. It shall be unlawful for
any person or perms sons, firm or firms,
corporation or corporations, licensed to sell alcoholic beverages,
intoxicating liquors, wine or beer in the City of Atlantic Beach,
Ylorida, to sell, offer for sale, serve, give away, dispense
or dispose of alcoholic beverages, intoxicating liquors, wine
or beer, or permit the same to be consumed upon his,
its or their premises between thehours oftwo o~clock A.M.
on ChristmasDay andseven o~clock A.M. on the day
following Christmas Day, and between thehours oftwo o~clock A.M.
onSundays andone o~clock P.M on Sundays and between thehours
oftwo o~clock A.M. andseven o~clock A.M. on all other
days, and the pre-mises in which any of the said
alcoholic beverages and in-toxicating liquors and wine or beer
are kept (except such premises as are primarily used
and conducted as grocery stores, markets, or primarily for the
sale and serving of prepared foods for consumption thereon)
shall be and remain securely closed during such hours, and
no person shall be permitted therein during such hours
for any purpose whatso-ever except to clean up said premises,
or to perform neces-sary functions
for closing the establishment.Section 2. It shall be unlawful for
any person or per-sons, firm or firms,
corporation or corporations operating for profit, but not licensed
to sell alcoholic beverages,intoxicating liquors, wines or beer in
the City of Atlantic Beach, Florida, to Serve, give
away or dispense alcoholic beverages, intoxicating liquors, wine or
same to be consumed upon his, its, or their premises be-
tween the hours of two o'clock A. M, on Christmas Day and
seven o'clock A, M. on the day following Christmas Day,
and between the hours of two o'clock A> M, on Sundays and
one o'clock P. M, on Sundays, and between the hours of two
o'clock A, M. and seven o'clock A, M> on all other days.
Section 3. No vendor of alcoholic beverages (except
vendors of beverages containing alcohol of not more than
14°~ by weight, and wines regardless of alcoholic content}
shall be permitted to conduct his place of business in any
location within the City of Atlantic Beach, Florida, except
the followingo
a) The premises commonly known as the Atlantic
Beach Hotel.
b) The premises commonly known as Le Chateau.
c) The club house site and pro shop site of
the Selva Marina Country Club<
d) The premises commonly known as The Sea Turtle.
e) Ali premises located and fronting on Atlantic
Boulevard from a point 200 feet east of the
center line of a street designated Sylvan
Drive, west to the City Limits.
f) All premises located and fronting on the
Mayport Road and in Business "B" Zone,
Section 4. No vendor of alcoholic beverages contain-
ing alcohol of not more than 14%by Wcig~t, and wines regard-
less of alcoholic content, for consumption on premises,
shall be permitted to conduct his place of business in the
Business "A" Zone east of a line 200 feet east and parallel
to the center line of a street designated Sylvan Drive un-
less such place of business is a restaurant or delicatessen
and the sale of beer and wine is incidental to the sale
of food.
Section 5. Each vendor licensed to sell alcoholic bev-
erages, intoxicating liquors, wines or beer in the City of
Atlantic Beach, during all times his premises are open for
business or in which members of the public are admitted,
shall maintain not less than five-foot candles of
light in all parts of his premises to which members of the
pub-lic are admitted and the sale of said beverages is made
or said beverages dispensed or consumedp and it shall be
unlaw-ful for any such vendor to sell, offer for sale, serve
or dispense, or permit to be consumed any alcoholic
beverages,intoxicating liquors, wines or beer upon part of his or
its premises, unless the same is then and there lighted
with not less then five-foot candies

Section 6. It shall be unlawful for any vendor of
alcoholic beverages, intoxicating liquors, wines or beer
to install, maintain, harbor or play at a physical location
in anywise outside of any building comprising the whole or
any part of such vendors business premises any musical or
noise producing instrument, public address or loud speaker
equipment, or portion thereof whatsoever.
Section 7. Any person, firm or association, or in
the case of a corporation the officers, employees or agents
thereof, violating any of the provisions of this ordinance
shall upon conviction be punished by fine not exceeding
5500.00 or by imprisonment not exceeding 30 days, either
one or both in the discretion of the Court trying the
offender.
Section 8. Ordinance Numbers 10-59-6,
10-59-7, and 177 of the City of Atlantic Beach,
Florida, and all Ordinances or parts of Ordinances in conflict herewith,
are, to the ex-tent of
such conflict, hereby repealed.Section 9. This ordinance
shall take.effect immediately upon being passed in
