Illlegal unit separation City of Atlantic Beach Community Development Dept. 14 �► 800 Seminole Road _ Atlantic Beach, Florida 32233 Telephone(904)247-5826 0 www.coab.us February 5, 2020 Mr. Eric Fromme 1369 Violet St. Atlantic Beach, FL 32233 RE: 1365&1369 Violet Street Dear Mr. Fromme: In response to your request regarding the above mentioned Property, please be advised as follows: The Property is located in the Residential Medium Density ("RL")functional land use category according to the Future Land Use Map("FLUM")series adopted as part of the 2030 Comprehensive Plan,and is zoned Residential General,Two Family("RG"). Section 24-107 (b) of the Land Development Codes identifies the uses permitted within the RG zoning district shall be: "(1)Single-family dwellings. (2)Two-family(duplex)dwellings,subject to density limitations. (3)Accessory uses as set forth in section 24-151. (4)Two-unit townhouses,subject to density limitations,compliance with article IV,subdivision regulations and section 24-88. (5) Government uses, buildings and facilities. (6) Family day care homes and group care homes." In 1984,the city issued a building permit for a duplex for the above mentioned property. A duplex is a building that is divided into two separate homes on single parcel of real estate owned by one person/entity. It is not possible to subdivide and sell each unit individually.The city does not have any record of building permits that converts this structure into a townhouse. Townhouses and duplexes have different building code requirements.
